             MEMORANDUM FOR Deputy Commanding General (Logistics)
             SUBJECT: Legal Opinion on Asbestos Hazard on Barges


             1. This memorandum discusses the legal results of exposing
             soldiers to asbestos dust on the ARAMCO barges.
             2. There is asbestos insulation exposed on the ARAMCO
             barges.
             3. It is not illegal to put soldiers on barges while the
             Contractor is removing the asbestos during refurbishment ol
             the barges.
             4. It is possible that soldiers living on the barges while
             refurbishment is ongoing will inhale asbestos dust.
             S. Soldiers under the Feres Doctrine are not able to sue the
             U.S. or its agents. This legal doctrine is being eroded.
             6. The U.S. faces potential future liability and certain
             present morale problems if soldiers are exposed to asbestos
             dust.
             7. I recommend, therefore, that you obtain occupational
             safety specialists to monitor dust levels and to not allow
             soldiers into areas where dust levels are unsafe.
